Three Tennessee miners rescued after fire (Reuters)

NASHVILLE, Tenn (Reuters) ? Three miners were trapped underground by smoke for several hours on Wednesday before being brought safely to the surface at the Young zinc mine in Tennessee, authorities said.

Two other miners were taken to a local hospital suffering from minor smoke inhalation after a drill rig caught fire at the mine in New Market, Tennessee, Fire Department Captain Sammy Solomon said.

Fifty-four miners were in the zinc mine when the rig caught fire about 800 feet from the surface, and 51 of them were able to walk out of the mine, Solomon said.

"They are on the surface, they are on the ground. They are officially out," Solomon said just before 4 p.m. local time, adding that they appeared to be fine.

A team from state-run Tennessee Mine Rescue led the trapped miners safely to the surface. The miners had been talking with authorities at the surface by phone after the fire broke out. The fire call came in about 1 p.m.

Solomon, who has been a captain of the volunteer fire and rescue unit for more than 20 years, said a mine fire was almost unheard of in New Market, a town about 15 miles north of Knoxville in eastern Tennessee.

"This is the first time it's ever happened that I could ever remember," Solomon said.

Nyrstar, which owns the Jefferson County mine and has operations around the world, said in a statement that it was working with the Mine Safety and Health Administration and mine rescue teams to ensure that it was safe to resume mining.

Jefferson County is one of four counties in Tennessee with active zinc mining and milling operations that make it the nation's second-largest zinc producer, according to state data.

Canadian coach Hay secretive about his starting goaltender for tournament opener

EDMONTON - It would be more comforting for Canada's fans if it was obvious who their starting goaltender is for the first game of the 2012 world junior hockey championship.

But it isn't obvious.

Since a 5-3 pre-tournament loss to Sweden on Friday, there's been a question mark hanging over the host country's goaltending situation. Canada opens the tournament Monday against Finland.

Head coach Don Hay said prior to the team's practice Sunday he'd made his choice, but he didn't reveal it to reporters.

Mark Visentin and Scott Wedgewood practised without knowing, although Hay planned to inform his goalies after a team meeting later which one would get the coveted start in the tournament opener.

"I feel good about which guy I'm going to pick," Hay declared. "I know right now who it's going to be and I'll let them know later."

Hay has maintained since selection camp earlier this month that Visentin is his No. 1 goalie because of Visentin's experience playing in the 2011 tournament in Buffalo, N.Y.

But after Visentin gave up four goals on 17 shots and Wedgewood stopped all 10 shots he faced before the Swedes scored an empty-net goal, questions arose over which goalie was the most ready for the tournament.

Hay did say he plans to play both goalies in the tournament. That's not unusual.

The backup often gets a game in the preliminary round against the weaker country promoted from the second-tier world championship, which would be Thursday's game against Denmark.

"Both goalies feel, at least I feel that way right now, is that both goalies feel there's confidence coming from me to them," Hay said. "No matter who we play, no matter what time of the game it is, or against whoever, I think the goalies should have a lot of confidence."

The U.S. meets Denmark in the later Pool A game in Edmonton. Latvia and Sweden open Pool B games in Calgary on Monday afternoon, followed by defending champion Russia versus Switzerland at night.

The top team in each pool earns byes to the semifinals. The second and third seeds cross over to meet in the quarter-finals.

Canada has won a medal in this tournament 13 straight years, including five gold from 2005 to 2009, and has played in the final every year for the last decade. Canada took silver the last two years.

Securing the bye to the semifinals provides rest and an extra day of preparation to the countries who earn them, but in recent tournaments, the bye hasn't been that much of an advantage.

Three of the last four winners have come through a quarter-final ? Canada in 2008, the U.S. in 2010 and Russia in 2011.

Canada opens against the Finns after beating them 3-1 in an exhibition game Dec. 19. Finland played hard in that game despite having just recently arrived in Canada.

"We were in that game," Finnish coach Raimo Helminen said. "I don't know if we can be better but I hope so (that) we can compete against the big favourite."

Helminen, too, was secretive on the subject of his starting goalie. Chris Gibson, who plays for the Quebec Major Junior Hockey League's Chicoutimi Sagueneens, was outstanding his two periods of the exhibition game against Canada.

Sam Aittokallio played the last period and the Colorado Avalanche prospect has the experience of playing one game in the tournament in Buffalo.

The Finns last won this tournament in 1998 and are looking for a bounce-back year after finishing sixth in Buffalo. They have six returning players, as well as a player who is considered the best one outside the NHL this season in Mikael Granlund.

The first-round pick (ninth overall) of the Minnesota Wild is a player Canada must pay attention to, says Hay.

"The Granlund line is a very talented line," Hay said. "They're very explosive and they're the key I feel to their team and we have to make sure we limit their offensive opportunities."

Canada went 2-1 in pre-tournament play. Visentin of the Niagara IceDogs made 22 saves in the exhibition games versus the Finns. The first-round pick of the Phoenix Coyotes is more conservative in his movements in net than the acrobatic Wedgewood.

Visentin was handed the starting job for the medal round in Buffalo and backstopped Canada to wins in the quarter-final and semifinal. Canada was leading 3-0 heading into the third period of the gold-medal game, but Russia scored five unanswered goals on Visentin to take the title.

He's never shirked from addressing his role in the collapse. The maturity and experience he gained through that experience is considered valuable to Canada's chances in this tournament.

"My mentality is the same as the team's," Visentin said Sunday. "We want to get better each and every day and once the tournament starts we need to bring our 'A' game every day so that's what I'm going to do."

Wedgwood, who plays for the Plymouth Whalers, stopped 24 of 25 shots in Canada's 7-1 victory over Switzerland on Thursday. The third-round pick of the New Jersey Devils was a standout in selection camp.

"The coaches are going to make a decision they feel comfortable with and as a goalie you've got to deal with it," Wedgewood said. "When you get your opportunity, take it."

The Canadian team spent Christmas Eve at the home of Edmonton Oilers president of hockey operations Kevin Lowe and then received Christmas gifts from Hockey Canada back at their hotel.

"The last week has been fun, we worked on a lot, I think we got a lot better and we became closer as a team, but the tournament is finally here and the atmosphere is going to be great," Canadian captain Jaden Schwartz said. "Finland is going to be a first tough contest for us so we're real excited."

Police seek motive in Texas family deaths

By the CNN Wire Staff

December 27, 2011 -- Updated 0039 GMT (0839 HKT)

Seven found dead in Texas apartment

STORY HIGHLIGHTS

  • NEW: Shooter was dressed as Santa Claus
  • Police say the family was opening Christmas gifts when the shootings occurred
  • The shooter is believed to be related to the family by marriage, authorities say
  • Autopsies were being conducted Monday, according to police

Dallas (CNN) -- Autopsies were being conducted Monday on seven family members who were fatally shot by a man dressed as Santa Claus at a Christmas gathering, police said.

"The information we have is that this is a family, some of them related by marriage but mostly by blood," Grapevine, Texas, police Sgt. Robert Eberling said Monday. "They have lived in other areas in the (Dallas) metroplex and they came yesterday for a Christmas gathering."

Authorities said the shooter "was one of the individuals inside the apartment that was also deceased," Eberling said. "We know he is a family member ... we are working to find out why exactly this took place. We contacted other family members to piece this together."

The shooter is believed to have been related to the family by marriage, he said. Officers were investigating whether divorce was an aspect of the shooting, he said.

The identities of the victims were expected to be released Tuesday, along with autopsy results, Eberling said.

Police said the group apparently had just finished opening their gifts when the shootings occurred in the living room of the apartment in Grapevine, about 25 miles northwest of Dallas.

Authorities responded to the address Sunday after receiving a 911 call from the apartment, but hearing only an open line, police said in a statement.

The seven bodies -- four female adults and three adult males -- were found when officers entered the apartment. "All victims appear to have gunshot wounds," said the statement.

The victims range in age from 15 to 58 or 59 years old, Eberling said Monday.

"The biggest thing we want to stress is we don't believe this person had barged his way in," Eberling said. "It appears they had all gathered in the living room for your garden-variety Christmas celebration."

CNN's Carma Hassan, Chuck Johnston, and Nick Valencia contributed to this report.

WWE Raw SuperShow results: Kane rises to hate

CHICAGO ? WWE Champion CM Punk?s Second City homecoming was marred by the underhanded actions of Interim Raw General Manager John Laurinaitis and Dolph Ziggler, while the diabolical Kane finally shed some fire on his recent attacks on John Cena.

1348109519001|07:24Kane explained why he attacked John Cena (WATCH | PHOTOS)
After two brutal assaults on John Cena, The Big Red Monster finally revealed why he targeted the Cenation leader. The monster?s reason? Hate.

Standing behind a wall of fire, Kane made it clear that he?s disgusted by Cena?s ?Rise Above Hate? T-shirt slogan, because humans are hateful by nature. The twisted demon then said he?s going to help the powerful Superstar understand this by leading WWE fans in a chant of ?Cena sucks! Cena sucks!? Some members of the WWE Universe followed Kane, others didn't, but the outcry seemed to shake the confident competitor.

1348080654001|03:36Dolph Ziggler def. WWE Champion CM Punk in a Title-Free Gauntlet Match (WATCH | PHOTOS)
Still sucking air after his first Gauntlet Match, Punk rallied against the talented, but arrogant Dolph Ziggler. That was until Mr. Laurinaitis stuck his nose in. Distracting The Straight Edge Superstar by making a mid-match announcement, the Interim Raw General Manager allowed Ziggler to steal one and earn a WWE Title opportunity against the champion next Monday night. The showoff was so pumped about his victory, he snatched Punk?s title and taunted a disgusted Chicago crowd.

1348056853001|03:09WWE Champion CM Punk def. Jack Swagger in a Gauntlet Match (WATCH | PHOTOS)
Forced by Interim Raw General Manager John Laurinaitis to face Jack Swagger, Dolph Ziggler and Mark Henry in a Gauntlet Match, WWE Champion CM Punk knew he had to dispatch of his first opponent early. It wasn't easy getting by the former World Heavyweight Champion, but even with the shrill Vickie Guerrero attempting to sway the bout for her client, The Straight Edge Superstar put Swagger to bed with a devastating roundhouse kick.

Alberto Del Rio vowed to be more ruthless (PHOTOS)
For once, The Mexican Aristocrat looked humbled. Rolled out in a wheelchair by Ricardo Rodriguez, Alberto Del Rio revealed that he suffered a torn groin in the previous Monday?s main event, which will cause him to miss some ring time. (FULL STORY) When WWE fans cheered his misfortune, Nikki and Brie Bella came to their crush?s defense, but only ended up bickering between themselves. Irritated, Del Rio sent the twins away and vowed to return more vicious than ever in 2012.

1348011830001|03:38Big Show def. David Otunga by Disqualification (WATCH | PHOTOS)
With one arm tied behind his back, Big Show squared off with the litigious David Otunga, but quickly learned he?d been set up. Sabotaged by the vicious Mark Henry, the giant was nearly brutalized until World Heavyweight Champion Daniel Bryan hit the ring and distracted The World?s Strongest Man. Henry managed to escape before Show could destroy him, but Otunga wasn?t so lucky. The World?s Largest Athlete hit him with a chokeslam so huge, the lawyer may have forgotten where he went to college.

1348011823001|06:08John Cena def. The Miz by Count-out; R-Truth returned (WATCH | PHOTOS)
Outraged over Kane?s recent attacks, John Cena demanded The Big Red Monster face him in the ring live in Chicago. Instead, he got The Awesome One. Looking to end 2011 on a high note, The Miz challenged the man he beat at WrestleMania XXVII and ended up getting tossed around by a very focused Cena.

Frustrated, Miz rolled out of the squared circle and talked trash until he got counted out. But before he could escape without any more damage, he was stopped by R-Truth. Returning after being put in the hospital by The Awesome One, Truth recklessly battered his former friend around the ringside area and then warned, ?This New Year?s, acquaintances be forgot? No! They?re going to get got!?

1348008507001|02:27U.S. Champion Zack Ryder & Eve def. Tyson Kidd & Natalya (WATCH | PHOTOS)
Now that Zack Ryder has the United States Championship, he?s set his sunglasses on a greater prize ? Eve. Teaming with the gorgeous Diva after spoiling her with Broski merchandise for Christmas, Long Island Iced-Z proved that he can work very well with the former Divas Champion. Eve definitely enjoyed their success over Tyson Kidd & Natalya, but she doesn?t seem ready to accept Ryder?s offer for a date.

1348011801001|03:14Booker T def. Intercontinental Champion Cody Rhodes in a Title-Free Match (WATCH | PHOTOS)
Aw, shucky ducky. Three days after his distraction caused Cody Rhodes to fall to Zack Ryder on SmackDown, Booker T beat his vicious rival in the ring with the scissors kick. The six-time World Champion proved that not only does he have Cody?s number, but he?s still got it in the ring.

Interim Raw General Manager John Laurinaitis set a Gauntlet Match for WWE Champion CM Punk (PHOTOS)
The Chicago crowd hoping to give their hometown hero a rousing ovation was disappointed when Raw kicked off with Interim General Manager John Laurinaitis mocking CM Punk's signature entrance. With the WWE Champion's T-shirt pulled over his suit jacket, the executive proceeded to give himself credit for the exciting changes in sports-entertainment.

That was all it took to bring out a livid Second City Savior. Explaining that Raw?s revolution is due to Punk being ?the best wrestler in the world,? the WWE Champion looked ready to hit the EVP with a GTS. That?s when Laurinaitis announced his idea for the evening ? Punk will face three opponents in a Gauntlet Match and if any of those competitors beat the champion, they will receive a WWE Title Match next week on the first Raw of the New Year!?

The Straight Edge Superstar was game, but he wanted to up the ante. If the tattooed Superstar beat all three Superstars, he proposed that he get a fourth match with none other than John Laurinaitis himself.

'Anonymous' hackers target US security think tank (AP)

LONDON ? The loose-knit hacking movement "Anonymous" claimed Sunday to have stolen thousands of credit card numbers and other personal information belonging to clients of U.S.-based security think tank Stratfor. One hacker said the goal was to pilfer funds from individuals' accounts to give away as Christmas donations, and some victims confirmed unauthorized transactions linked to their credit cards.

Anonymous boasted of stealing Stratfor's confidential client list, which includes entities ranging from Apple Inc. to the U.S. Air Force to the Miami Police Department, and mining it for more than 4,000 credit card numbers, passwords and home addresses.

Austin, Texas-based Stratfor provides political, economic and military analysis to help clients reduce risk, according to a description on its YouTube page. It charges subscribers for its reports and analysis, delivered through the web, emails and videos. The company's main website was down, with a banner saying the "site is currently undergoing maintenance."

Proprietary information about the companies and government agencies that subscribe to Stratfor's newsletters did not appear to be at any significant risk, however, with the main threat posed to individual employees who had subscribed.

"Not so private and secret anymore?" Anonymous taunted in a message on Twitter, promising that the attack on Stratfor was just the beginning of a Christmas-inspired assault on a long list of targets.

Anonymous said the client list it had already posted was a small slice of the 200 gigabytes worth of plunder it stole from Stratfor and promised more leaks. It said it was able to get the credit card details in part because Stratfor didn't bother encrypting them ? an easy-to-avoid blunder which, if true, would be a major embarrassment for any security-related company.

Fred Burton, Stratfor's vice president of intelligence, said the company had reported the intrusion to law enforcement and was working with them on the investigation.

Stratfor has protections in place meant to prevent such attacks, he said.

"But I think the hackers live in this kind of world where once they fixate on you or try to attack you it's extraordinarily difficult to defend against," Burton said.

Hours after publishing what it claimed was Stratfor's client list, Anonymous tweeted a link to encrypted files online with names, phone numbers, emails, addresses and credit card account details.

"Not as many as you expected? Worry not, fellow pirates and robin hoods. These are just the `A's," read a message posted online that encouraged readers to download a file of the hacked information.

The attack is "just another in a massive string of breaches we've seen this year and in years past," said Josh Shaul, chief technology officer of Application Security Inc., a New York-based provider of database security software.

Still, companies that shared secret information with Stratfor in order to obtain threat assessments might worry that the information is among the 200 gigabytes of data that Anonymous claims to have stolen, he said.

"If an attacker is walking away with that much email, there might be some very juicy bits of information that they have," Shaul said.

Lt. Col. John Dorrian, public affairs officer for the Air Force, said that "for obvious reasons" the Air Force doesn't discuss specific vulnerabilities, threats or responses to them.

"The Air Force will continue to monitor the situation and, as always, take appropriate action as necessary to protect Air Force networks and information," he said in an email.

Miami Police Department spokesman Sgt. Freddie Cruz Jr. said that he could not confirm that the agency was a client of Stratfor, and he said he had not received any information about a security breach involving the police department.

Anonymous also linked to images online that it suggested were receipts for charitable donations made by the group manipulating the credit card data it stole.

"Thank you! Defense Intelligence Agency," read the text above one image that appeared to show a transaction summary indicating that an agency employee's information was used to donate $250 to a non-profit.

One receipt ? to the American Red Cross ? had Allen Barr's name on it.

Barr, of Austin, Texas, recently retired from the Texas Department of Banking and said he discovered last Friday that a total of $700 had been spent from his account. Barr, who has spent more than a decade dealing with cybercrime at banks, said five transactions were made in total.

"It was all charities, the Red Cross, CARE, Save the Children. So when the credit card company called my wife she wasn't sure whether I was just donating," said Barr, who wasn't aware until a reporter with the AP called that his information had been compromised when Stratfor's computers were hacked.

"It made me feel terrible. It made my wife feel terrible. We had to close the account."

Wishing everyone a "Merry LulzXMas" ? a nod to its spinoff hacking group Lulz Security ? Anonymous also posted a link on Twitter to a site containing the email, phone number and credit number of a U.S. Homeland Security employee.

The employee, Cody Sultenfuss, said he had no warning before his details were posted.

"They took money I did not have," he told The Associated Press in a series of emails, which did not specify the amount taken. "I think `Why me?' I am not rich."

But the breach doesn't necessarily pose a risk to owners of the credit cards. A card user who suspects fraudulent activity on his or her card can contact the credit card company to dispute the charge.

Stratfor said in an email to members, signed by Stratfor Chief Executive George Friedman and passed on to AP by subscribers, that it had hired a "leading identity theft protection and monitoring service" on behalf of the Stratfor members affected by the attack. The company said it will send another email on services for affected members by Wednesday.

Stratfor acknowledged that an "unauthorized party" had revealed personal information and credit card data of some of its members.

The company had sent another email to subscribers earlier in the day saying it had suspended its servers and email after learning that its website had been hacked.

One member of the hacking group, who uses the handle AnonymousAbu on Twitter, claimed that more than 90,000 credit cards from law enforcement, the intelligence community and journalists ? "corporate/exec accounts of people like Fox" News ? had been hacked and used to "steal a million dollars" and make donations.

It was impossible to verify where credit card details were used. Fox News was not on the excerpted list of Stratfor members posted online, but other media organizations including MSNBC and Al-Jazeera English appeared in the file.

Anonymous warned it has "enough targets lined up to extend the fun fun fun of LulzXmas through the entire next week."

The group has previously claimed responsibility for attacks on credit card companies Visa Inc. and MasterCard Inc., eBay Inc.'s PayPal, as well as other groups in the music industry and the Church of Scientology.

Shell Oil Messes Off Two Coasts

Shell's 100-mile-long oil slick off the Nigerian coast, 21 December 2011. Envisat ASAR image analyzed by SkyTruth from data courtesy of the European Space Agency.Shell has admitted to spilling up to 40,000 barrels (1.4 million gallons) of crude oil into the ocean about 75 miles (120 km) off Nigeria on Wednesday. The spill occurred while it was transferring oil from a floating oil platform to a tanker.

Satellite pictures captured by independent monitors Skytruth (more here) show a 356-square-mile (923-square-km) slick approaching the oil-battered coast of the Niger Delta. All production from the Bonga field?normally about 200,000 barrels (7.2 million gallons) a day?has been suspended in the wake of the spill.

The Guardian reports on skepticism of Shell's estimates, based on its poor record in the region:

[A] leading Nigerian human rights group said Shell's figures about the quantity of oil spilled or the clean-up could not be relied on. "Shell says 40,000 barrels were spilled and production was shut but we do not trust them because past incidents show that the company consistently under-reports the amounts and impacts of its carelessness," said Nnimmo Bassey, head of Environmental Rights Action, based in Lagos. The spill, one of the worst off the coast of Nigeria in 10 years, is particularly embarrassing for Shell, coming only four months after a major UN study said it could take Shell and other oil companies 30 years and $1bn to clean spills in Ogoniland, one small part of the oil-rich delta. The company also admitted responsibility in August for two major spills in the Bodo region of the delta that took place in 2008, but has yet to pay compensation.

Shell also admitted to a spill in the Gulf of Mexico Sunday of some 13,400 barrels of drilling mud mixed with synthetic oil from the Deepwater Nautilus?a sister rig to the Deepwater Horizon.

The spill occurred at the Appomattox discovery, just 26 miles southeast of last year's disastrous spill. Shell plans five new exploratory wells at Appomattox, hoping to recover more than 250 million barrels of oil... though the Houston Chronicle reports it could be weeks before the company can resume drilling in the hotly-disputed site:

The Appomattox project is at the heart of a high-stakes dispute between environmentalists and the federal government over offshore drilling... In separate cases that have since been consolidated, conservationists are arguing that the government acted prematurely in green-lighting the plan without first finishing an environmental study of the Gulf... The cases present a major test of the federal government's power to swiftly review and approve deep-water exploration?plans.

'Marilyn' actor Branagh parallels his character (omg!)

FILE - In this Nov. 20, 2011, file photo, British actor Kenneth Branagh arrives for the UK Premiere of "My Week With Marilyn" at a central London cinema. Branagh, as Laurence Olivier, Monroe's exasperated co-star and director on "The Prince and the Showgirl," has been nominated for supporting actor for the role at the Golden Globes. (AP Photo/Joel Ryan, File)

New York (AP) ? Long before Kenneth Branagh stepped into the role of Sir Laurence Olivier in "My Week With Marilyn," there already were strong parallels between them.

Both are synonymous with film adaptations of William Shakespeare, delivering lines with implausible realism, and earning accolades for their troubles. Each starred and directed their own successful adaptations of "Hamlet," and "Henry V," that earned Oscar nods for their work on both sides of the camera. (Olivier received an honorary award that included directing the film).

With such similarities, it seems fitting that Branagh earned a Golden Globe nomination for his performance as the legendary actor.

"He was a master of his craft, and at the same time very vulnerable," Branagh says of Olivier.

"My Week with Marilyn," is in theaters and stars two-time Oscar nominee Michelle Williams as Marilyn Monroe. It's based on the writings of Colin Clark, who spent a week with the iconic actress in 1957 while she was filming "The Prince and the Showgirl" in the United Kingdom.

"When they were making this film, Olivier, saw it as means to reinvigorate his career, especially in the states," Branagh said. "But he found it a challenge to work with Marilyn (Monroe), whom he considered less than professional."

Olivier eventually lightened up to Monroe, admitting she was wonderful in the film.

But Branagh says his co-star, Michelle Williams, who plays the iconic Monroe, has been wonderful from the start.

"Before we ever started filming, she learned everything she could about Marilyn, and played her flawlessly."

"After some time you live the character, and stop playing it," he added.

Olivier was 50 when he starred and directed "The Prince and the Showgirl," and Branagh was 50 when he portrayed Olivier in the film.

"He had this attitude of, 'It's not over, yet,' and I feel the same way," Branagh said.

The actor always has held Olivier in high regard and is humbled whenever critics draw comparisons. That comes as no surprise when you consider Olivier's body of work. Classic performances include Heathcliff in "Wuthering Heights," the title characters in "Othello" and "Richard II," and Andrew Wyke from "Sleuth."

"How could you not be an Olivier fan? Just think of that scene in Marathon Man, where he's torturing Dustin Hoffman with a dentist's drill. That scene alone could be responsible for a generation of British not going to the dentist," Branagh said before breaking into laughter.

So while he's a serious actor, Branagh also has a good sense of humor. And he's going to need it at the Golden Globes, where Ricky Gervais returns as host.

Branagh and Gervais grew up in the same English town of Reading; Branagh moved there as a child from Belfast. Branagh is a year older than Gervais and says their schools often played football games against one another. Branagh was an avid footballer through school.

"I'm not sure if he ever played," the actor said of Gervais. "But if he did, we certainly played against one another."

Because of the hometown connection, Branagh expects Gervais to focus some the jokes about growing up in Reading. And the actor says he has no problem with that.

Nawaz supports Kayani, not Haqqani

ISLAMABAD - Chief of Army Staff (COAS) General Ashfaq Pervez Kayani has submitted his rejoinder to the Supreme Court, insisting that the ?memo is a reality? and an attempt to lower the morale of Pakistan?s armed forces.
PML-N chief Nawaz Sharif, who also submitted his reply along with Ishaq Dar, Ghaus Ali Shah and other petitioners, marinated that whatever he had stated and presented in the court was ?all correct?. He said that he supports Gen Kayani?s statement and Mansoor Ijaz?s reply but rejects Haqqani?s statement.
ISI DG Lt-Gen Ahmed Shuja Pasha, who filed his reply late night, also stood by his earlier statement that their was undeniable evidence of a conspiracy against the army and the country and the matter should be probed thoroughly.
The federal government, in their rejoinder, repeated that the President and the PM have no link with the memo issue, while challenging again the Supreme Court?s authority to hear the case. The defence ministry said in its rejoinder that in the memo case, the court should not involve or include Husain Haqqani, the main accused in the case, and Mansoor Ijaz, the man who stocked the whole controversy.
The apex court had asked all the petitioners and respondents including, President, PM, COAS, ISI DG and others, to submit their rejoinders along with affidavits for the hearing of the memo case. Almost all have submitted their replies, but President Zardari has so far failed to comply with the court order.
In the last hearing, the chief justice told the AGP that no reply in a civil case means acceptance of guilt. Sources said that President Zardari would not file his statement on memo case and the government would stick to its previous stance that it had submitted reply on behalf of the president.
Talking to media, Attorney General of Pakistan (AGP) Maulvi Anwarul Haq said that Gen Kayani?s rejoinder had been submitted to the court. The AGP said that COAS stood firm on his previous stance in the rejoinder. In an affidavit submitted in the court, Kayani said that all his earlier statements were based on facts and nothing had been kept hidden from the court.
In his rejoinder the army chief said that memo issue was about the national security and it was an attempt to lower the morale of army. The COAS also held that the reports regarding the memogate are correct and evidence is available of the contacts made in the context of the conspiracy.
?There is nothing denying the fact that the memo exists and it is also admitted to have been delivered and received by the US authorities. Therefore, there may be a need to fully examine the facts and circumstances leading to the conception and issuance of the Memo,? he writes. The COAS further stated the memo episode ?has an impact on national security and lowers the morale of Pakistan Army whose young officers and soldiers are laying down their lives for the security and defence of territorial integrity and political independence and sovereignty of Pakistan?.
The federation, in its rejoinder, repeated that the President Zardari and Prime Minister Gilani have nothing to do with the memo issue, ruling out that President Zardari was the originator of this memo. It again objected the Supreme Court jurisdiction to hear the memo scandal case under Article 184 (3) of the Constitution.
According to the sources, President Zardari will not file his concise statement on memo scandal case and the government would take stand on its previous stance that it had submitted reply on behalf of the president.
Nawaz Sharif in his rejoinder said that he had not sought stoppage of an inquiry being held by the parliament or administration, adding that in the same way parliament and administration could also not stop the court to play its constitutional role. He said that his petition was maintainable under article 184 of the constitution.
Sharif, in his affidavit, wrote that the issue should be investigated because whatever said and written on the issue was ?all correct?. The PML-N chief further said that he did not file the petition in SC under any political agenda.
Nawaz Sharif?s rejoinder says the reluctance on part of all the governmental functionaries concerned to seek resolution of an issue which has struck at the very roots of our state is rather enigmatic and the reaction of the respondent 1 and 2 to the said issue is no exception.
It was reiterated that the petitioner never prayed that the Parliament or the executive be restrained from doing their bit in the matter in question nor the honourable court restrained them from exercising the authority resting in them vis-?-vis the said matter. The PML-N chief re-emphasised that the Parliament or the executive having, allegedly, taken cognisance of the said issue creates no bar on the court of law in the matter of discharging their constitutional or legal obligations. It was denied that the petition under Article 184(3) of the constitution was not maintainable. PML-N leaders also supported the reply of Mansoor Ijaz.
Talking to media men at Supreme Court building, AGP Maulvi Anwarul mentioned that parliament and executive could not stop the proceedings of the Supreme Court on the memogate case.
Barrister Zafarullah in his rejoinder to the affidavit of James Logan Jones said that his affidavit requires to be proved through cross-examination of James Jones and Husain Haqqani in the court to determine his affidavit?s veracity. He emphasised that his petition is based on fundamental rights and maintainable in the court.
The court will take up the memo case today (Thursday). Asma Jahangir will appear on behalf of the main respondent Husain Haqqani and will also argue his miscellaneous application seeking recalling of the court?s Dec 1 order in ?memo? case. For the proper court decorum and smooth functioning, security measures have been taken at the premises of the Supreme Court. Entry of irrelevant persons shall not be allowed and no cellphone shall be allowed to be carried inside the courtroom.

ECB lends banks $639 billion over 3 years (AP)

FRANKFURT, Germany ? The European Central Bank is lending euro489 billion ($639 billion) to the continent's banks for an unprecedented three years in an effort to bolster Europe's stressed financial system.

The ECB said Wednesday that 523 banks took the loans. It didn't identify the banks involved.

Demand far exceeded market expectations of around euro300 billion.

It was the biggest ECB bank liquidity operation ever, surpassing the euro442 billion in one-year loans from June, 2009.

The ECB previously had given credit over periods of 13 months at most. Extending that is meant to reassure markets that banks will have long-term financing amid tensions triggered by the eurozone debt crisis.

The ECB has served as lender of last resort for banks when they cannot borrow elsewhere.

Ethics panel: No violations for Rep. Don Young (AP)

WASHINGTON ? The House Ethics Committee has concluded that Republican Don Young of Alaska did not receive improper donations to a legal defense fund.

The committee said Tuesday that 12 corporations owned and operated by the same seven peole each made the maximum $5,000 contribution ? for a total of $60,000.

The ethics panel said this is allowed because each company was a distinct legal entity in Louisiana. The companies provide different services or products to the maritime industry.

The committee said it is revising the rules, starting next year, to impose new contribution limits on owners who run multiple companies. In the Young case, with seven owners for the 12 contributing companies, the maximum would be $35,000 ? or $5,000 per owner.

A federal investigation of Young was dropped last year.

Galaxy Nexus users reporting touchscreen trouble, lower scores in multitouch games (video)

Looks like the honeymoon is ending a little early for some Galaxy Nexus users -- a pair of RootzWiki threads say that the device is struggling to maintain multitouch in some situations. Apparently the bug is repeatable, booting up a multitouch game like Gun Brothers or Shadow Gun will put the lower right hand portion of the smartphone's touchscreen in a finicky mood. We gave the glitch a go on a couple of different handsets, and were indeed thwarted by the touchscreen's tantrum. Turning the Nexus' screen on and off seems to fix the problem -- at least until you jump into your next game -- and the bug only seems to appear when the device is in landscape mode. This is likely a software bug, but until it's fixed, we'll just have to take it one touch at a time. Don't have a Nexus? See the glitch in action after the break.

[Thanks, Jim]

FCC Fridays: December 16, 2011

We here at Engadget tend to spend a lot of way too much time poring over the latest FCC filings, be it on the net or directly on the ol' Federal Communications Commission's site. Since we couldn't possibly (want to) cover all the stuff that goes down there, we've gathered up an exhaustive listing of every phone and / or tablet getting the stamp of approval over the last week. Enjoy!

The 'awesome' kitchen robots that prepare sandwiches (The Week)

New York ? That "Jetsons" future is coming: A team of German robots is demonstrating unprecedented culinary skill

How do you make generally charmless robots a little less intimidating? One word: breakfast. Take James and Rosie, two PR2 bots that are programmed to whip up meals with little more than a simple instruction. Here, a guide to the "awesome" domesticated androids built by artificial intelligence researchers at the Technical University of Munich and Willow Garage:

What do they do??
The real "beauty" of James and Rosie is that they're able to cook up food "without needing any additional programming," says Elizabeth Fish at PC World. Though the two robots were once only capable of making pancakes and sausages, they're now able to serve up sandwiches and stove-popped popcorn. Commands like "Make me a sandwich" will cause the bots to whir?around the kitchen, toasting bread, laying out meat and cheese, and spreading any condiments before stacking your meal.

?

How are they able to do it?
The robots are outfitted with "reasoning mechanisms" which help them make on-the-fly decisions around the kitchen, rather than decisions that are "preprogrammed," says Nancy Owano at PhysOrg. The bots use the "visual-detection systems from an Xbox Kinect" to observe their surroundings, and have "perception algorithms to assess surroundings," "make inferences about what they see," and "execute their tasks" at hand ? just like a human. For now, the robots are limited to working in their test kitchen, but could someday perform these actions in unfamiliar contexts.

And this is the future?
The robots are part of the school's Cognitive Robot Abstract Machine program, or CRAM. The project's goal is to create "a set of software tools to design and deploy robots that use cognition to manipulate items," notes Owano, which includes tasks like laundry and other household chores. In other words, they're part of a line of bots specifically built to do all the hard work so you don't have to. Besides, says Fish, "Everyone loves a good sandwich."

Ice Cream Sandwich alpha released for Xperia trio, is Sony Ericsson's '143' to the dev community (video)

Sony Ericsson has a clear stance on the Android dev community: one love. In what is, apparently, a first for the company, an alpha ROM of its in-development Ice Cream Sandwich port is available for install across a trio of unlocked Xperia devices -- the arc S, neo V and ray. But hold your horses on that download trigger finger, this early build is only for "advanced developers" and quite a few features, like Google apps, WiFi, Bluetooth, voice, FM radio and ANT+, simply aren't functional. In other words, don't depend on this as your daily driver, but do dive deep if you know what you're doing and want a peek at Google's soon-to-be ubiquitous OS upgrade. Head on over to the source below for the cautionary how-to and remember to flash at your own risk.
